1. Application Form and Allocation of Space

An intending exhibitor ("Exhibitor") is invited to select his site from the floor plan and make formal application on the appropriate form. The allocation of space will be effected upon receipt of application and the Organisers will confirm each such application by letter, facsimile or e-mail.

In the event of an Exhibitor giving written notice at any time prior to the Exhibition of his intention not to take possession of the space allocated to him or his failing to take possession of such space by 14 April 2009 or in the event of the Exhibitor ceasing to meet the qualifications on the basis of which an allocation of space was made to him or in the event of the Organisers not being reasonably satisfied as to the Exhibitor's intention to occupy the allocated space with approved exhibits, the Organisers may in its absolute discretion deal with such space as it thinks fit without being under any liability to refund or rebate any charges paid or due hereunder. The Organisers reserve the right to alter the layout of the Exhibition in any respect and at any time and to review and adjust cost of the space of Exhibitors whose stand area is affected by such alteration, but will not be liable to make any further payment or compensation and the Exhibitors will not be entitled to withdraw from their contracts.

2. Payment

An initial payment of 25% of the total hiring charge of the contract must be made with the submission of the application. A further payment of the 50% of the total hiring charge is due not later than 01 February 2009. The 25% balance payment must be paid before 14 April 2009.

3. Cancellation

A contracted Exhibitor who gives written notice of his intention not to take possession of the space or who failed to take possession as mentioned above for any reason shall be liable to pay the following cancellation charges to the organisers:

Up to 31 March, 2009 50% of space cost

After 01 April 2009 full amount of space cost.

These scales of charges will apply only from the date in which the organisers receive written notice as described above by letter, fax, or e-mail.

4. Limitation of Liability

The Organisers shall not be responsible under any circumstances to the Exhibitor for the acts or omissions of any other Exhibitors or any other persons whether its personnel or otherwise nor for the consequences of any breach by an Exhibitor of any of these Terms and Conditions. Articles exhibited will be at the sole risk and responsibility of the Exhibitor, his personnel or agents. Any damage to any such article whatsoever and howsoever caused by reason of fire, water, theft, accident or any other cause including defects in the installation, maintenance or dismantling of stands or otherwise shall be the responsibility of the Exhibitor.

The Exhibitor hereby indemnifies the Organisers and keeps them harmless against any liability, claim, demand, costs, charges or expenses arising as a result of allocating the space to the Exhibitor. Exhibitor will arrange insurance in the joint names of the exhibitor and the Organisers against all risks for which he is responsible under these Conditions and will, if so required, produce to the Organisers particulars of such insurance policy and evidence of the payment of the premium.

5. Force Majeure

The Organisers shall not be liable for any failure or delay in performing their obligations under this Agreement due to causes beyond its control including fire, flood, tempest or any other cause or as a result of government intervention, strike, lock outs, labor dispute, and riot. Any such failure or delay shall be remedied as soon as the force majeure event has come to an end.

6. Service Manual

A service manual giving information, guidance and direction to Exhibitors, designers and contractors will be issued in due time. All mandatory directions contained therein must be observed except where otherwise agreed by the Organizers in writing.

7. Jurisdiction

Any claim and dispute in relation to this contract shall be settled in accordance with the laws of the Kingdom of Bahrain and the non exclusive jurisdiction of the courts of Bahrain.
